摘 要 典制是中国固有法在近代法治现代化过程中遗存的制度之一，其体现了中国古代人们特有的生存智慧，是优秀中华传统文化的代表。典制出现于南北朝，发展于唐宋元，直到明清时期趋于成熟，由民间习惯走向国家制度，发挥了促进资源利用、维护当朝者统治等多重社会功能。
